Tearjerker is a small, independent operation based in Portugal

1. Private Information and Physical Address

Under the GDPR and Portuguese Data Protection laws, as this is a private home-office and studio for a freelance worker, the full physical address is withheld for privacy, as my personal fiscal data. For any more information, please contact me via email first to receive the necessary details.

2. Pricing & Payments

All prices are listed in Euros (€) and include all applicable taxes. In accordance with Portuguese law, Tearjerker operates under the VAT exemption regime (Artigo 53.º do CIVA) for small independent businesses.

  • Payments: I can accept MB WAY, Multibanco (via Ifthenpay), Credit Cards, Apple Pay, and PayPal (via Stripe).
  • Shipping: Costs are calculated at checkout based on your location and the weight of the items.

3. Shipping & Delivery

I ship almost worldwide from Portugal using CTT (Registered Mail).

  • Handling Time: Orders are processed and shipped within 2 to 4 business days.
  • Delivery Times: Estimated 2-5 days for Portugal, 5-10 days for Europe, and 10-20 days for the rest of the world (excluding the US).
  • Tracking: A tracking number will be provided as soon as the order hits the post office.

4. Right of Withdrawal & Returns (Direito de Livre Resolução)

  • Legal Status: Tearjerker is a non-professional, independent project. All sales are made between private individuals. Therefore, standard consumer protection laws for professional retailers do not apply to purchases made here.
  • Returns & Right of Withdrawal: Specifically, the right of withdrawal under articles 10 and following of the Portuguese Decree-Law n.º 24/2014 (February 14th) and the legal right of conformity under Decree-Law n.º 67/2003 (April 8th) do not apply. Since all items are sold as-is and are part of a private collection of hand-printed shirts, all sales are final.
  • Warranty & Hidden Defects: The warranty against hidden defects under articles 913.º and following of the Portuguese Civil Code (Código Civil Português) is applicable. This means that while I don’t accept returns because you changed your mind, I am responsible if the item has a structural defect that was not mentioned or visible in the photos at the time of purchase. However, every purchase made through our checkout is processed via secure payment providers. While I operate as a private seller, your transaction is covered by the standard buyer protection policies of the payment processor (e.g. PayPal Buyer Protection).
  • Product Nature: Please note that these are hand-printed items. Small variations in ink, placement, or texture are part of the artisanal process and the DIY aesthetic. These are not considered defects but characteristics of the manual print.

This doesn’t apply for records.

5. Dispute Resolution (RAL & Livro de Reclamações)

In the unlikely event of a dispute that we cannot resolve directly, you may contact an alternative dispute resolution body.

  • RAL (Alternative Dispute Resolution): Since we are based in the Leiria district, the competent body is the CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo. Visit: [www.cniacc.pt]

6. Data Protection (GDPR)

We only collect the data necessary to process your order (name, address, email). Your information is never shared with third parties, except for payment and shipping providers.
